About the programme

The course is about removing the legal time bombs from commercial contracts. Participants work through how liability clauses are worded, when risk passes, what security instruments are available, and the step-by-step technique of recovering debt through a claim and then in court.

Modules

The essential terms of supply, distribution and works contracts. When ownership and risk pass. Penalties, interest and limitation of liability.
How to work with a problem debtor from the first day of delay. Drafting a claim with the interest calculated. Settlement agreements and instalment schedules.
Building the evidence: correspondence, reconciliation acts, delivery notes. Interim measures: freezing the accounts and property of the debtor. Working with the bailiffs.
